General terms and conditions
These general terms and conditions of sale (hereinafter "GTC") create a legal agreement and apply to all orders for services concluded between the Client and the Photographer Camille PIN, Sole Proprietor, SIRET No.: 920.411.857.00013 whose registered office is located at: 8 avenue Reine Astrid, 13090 Aix en Provence.
ARTICLE 1: PURPOSE
Camille PIN offers private photographic services as presented on her website: http://camillepin.fr. It is the Client’s responsibility to read and understand these Terms and Conditions of Sale (TCS). Any booking implies full acceptance thereof, unless otherwise expressly agreed in writing between the Photographer and the Client. The Photographer reserves the right to amend these TCS at any time. Each booking is governed by the TCS in force on the date of said booking.
ARTICLE 2: BOOKING AND QUOTATIONS
Bookings may be made by email at pin.camille@hotmail.com, via the online contact form on the website http://camillepin.fr, or through a private message on the Instagram page @camillepin.photo.
This initial contact constitutes only a preliminary enquiry and does not in any way confirm or guarantee the booking of a session. A booking becomes effective only after mutual agreement has been reached and confirmed by email (regarding the date, time, location, and any applicable travel expenses), and upon payment of a 30% deposit, which constitutes a binding commitment from the Client. The booking shall only be deemed final once the deposit has been received.
In the case of reportage sessions (whether private, such as a wedding, or professional), the Photographer will, upon request, provide one or more quotations free of charge, specifying the nature and detailed pricing of the services offered. These quotations may be provided in hard copy or digital format, handed over in person or sent by email. Once signed and accompanied by a deposit of 30% of the total amount, the quotation becomes binding and final.
The Client may purchase gift cards to offer to others. Unlike other types of sessions, these must be paid in full at the time of order. The Photographer will then issue a receipt to the Client indicating the full name of the beneficiary and the type of session purchased. Gift cards are subject to an expiry date, after which the session shall be forfeited without the possibility of refund.
ARTICLE 3: RIGHT OF WITHDRAWAL
In accordance with the law, the Client has a statutory right of withdrawal within fourteen (14) working days, commencing on the day after the booking is confirmed. After this period, any amount already paid shall be non-refundable in the event of cancellation by the Client, except in cases of force majeure as outlined below.
This right of withdrawal does not apply where the photographic session has taken place before the end of the 14-day withdrawal period, as the delivery of photographs shall then be considered a clearly personalised service, pursuant to Article L121-20-2 of the French Consumer Code.
ARTICLE 4: PRICING AND PAYMENT
Prices are expressed in euros and are exclusive of tax (VAT not applicable under Article 293B of the French General Tax Code). The applicable prices are those in effect at the time of booking. Prices may be changed at any time without prior notice. Ongoing orders and previously issued quotations shall not be affected by such changes.
The remaining balance must be paid in full prior to delivery of the photographs. For weddings, the balance must be paid no later than seven (7) days before the event.
At the Client’s request, payment may be made in instalments without additional fees, according to a schedule agreed at the time of booking. In such cases, the final instalment must still comply with the conditions outlined above. Payment may be made in cash, by cheque, or via bank transfer. In the event of a dishonoured cheque, the Client will be notified by the Photographer and will have seven (7) days to settle the payment in cash or by bank transfer. If the balance remains unpaid, no photographs shall be delivered.
ARTICLE 5: CONDUCT OF THE SESSION AND CLIENT OBLIGATIONS
The Client confirms that they are of legal age, that they pose willingly, and that they authorise the taking of photographs. If the Client is a minor, a signed waiver from the legal guardians shall be required, and at least one legal guardian must be present on the day of the session.
The Photographer shall direct the session in collaboration with the Client(s) but reserves the right to refuse any request that does not align with her photographic style. Such refusal shall not entitle the Client to a refund.
During the session, the Photographer must not be hindered by any other professional or amateur photographers. The Client agrees to cooperate and facilitate the Photographer’s work. The Photographer cannot be held liable for reduced image quality due to lack of cooperation by one or more participants, or due to failure by the Client to follow preparatory advice. The Photographer will adapt to the environment, weather conditions, and individual behaviour as far as reasonably possible. Parents remain responsible for their children. In case of difficulties, if the Photographer deems the session cannot proceed, she reserves the right to reschedule or cancel the session with a refund.
The number of outfits or set-ups shall be agreed in advance and is limited according to the session duration.
The Client agrees to be punctual for the scheduled session. The session will end at the originally agreed time; any delay on the part of the Client may reduce the total time allocated to shooting. Delays exceeding thirty (30) minutes will result in the cancellation of the session, with all amounts already paid forfeited, without refund, credit, or rescheduling
ARTICLE 6: POST-PROCESSING OF DIGITAL FILES
The Client confirms they are familiar with the Photographer’s artistic approach and are hiring her services with full knowledge of her photographic style. The Photographer undertakes to use her full skills and artistic judgement to create images consistent with her vision. The Client acknowledges that photographs shall not be subject to rejection based on personal aesthetic preferences.
The Photographer retains full discretion regarding the selection of images and the editing applied, in accordance with her photographic style as demonstrated on her website (http://camillepin.fr) and Instagram page (@camillepin.photo).
All delivered images are professionally edited either globally (e.g., exposure, framing, colour balance) or locally (e.g., minor skin or hair retouching). Should the Client request more advanced editing after delivery, a new quotation may be issued.
ARTICLE 7: DELIVERY OF IMAGES
The Client shall not, under any circumstances, be entitled to access the raw image files (RAW format). Digital files are delivered in high-quality JPEG format and include the right to reproduce for personal use. The Photographer undertakes to deliver the final photographs within a maximum of six (6) weeks, unless otherwise agreed in writing in the quotation. Digital files will be provided via a download link valid for seven (7) days or through an online gallery protected by a password.
ARTICLE 8: MODIFICATION, POSTPONEMENT OR CANCELLATION
Any request for modification (date, location, time) by the Client must be made no later than seventy-two (72) hours prior to the scheduled session, except in cases of force majeure. In the event of postponement, the Photographer shall not be held liable for the failure to achieve certain session-specific characteristics (shooting environment, season, weather conditions, etc.). Should the Client cancel the service, the deposit paid shall be retained, except in cases of force majeure. For any order already in the creation process, no cancellation shall be accepted, and the full amount shall remain payable. In the context of a wedding, the outstanding balance shall become due if cancellation occurs less than two (2) months before the event.
ARTICLE 9: LIABILITY
9.1: Adverse weather conditions
In the event of adverse weather conditions (storms, high winds, heavy rain, etc.) or extreme weather (heatwaves, etc.), the Photographer shall not be held responsible for the non-performance or partial performance of services initially planned outdoors. No refunds shall be issued. Where the nature of the session allows, it will be rescheduled under the conditions outlined in Article 8.
9.2: Force majeure or illness
Force majeure shall be defined as any external, unforeseeable, and unavoidable event that renders the performance of the service impossible. Either party may invoke force majeure provided the criteria are met. The Photographer or the Client shall notify the other party as soon as possible by telephone or email.
The Photographer reserves the right to cancel or postpone a service in the event of force majeure or illness. Such cancellation shall not give rise to any liability or entitlement to compensation of any kind. The session shall be rescheduled by mutual agreement at a later date, without additional charge.
For weddings, the Photographer will make every effort to find a replacement photographer from her network to carry out the service under similar contractual conditions but cannot guarantee this
9.3: Damage
The Photographer is covered by professional liability insurance.
The use of laser lighting is strictly prohibited during photo sessions. In the event of non-cooperation, the Photographer reserves the right not to take any photographs, and no refund shall be due to the Client.
If the Photographer’s equipment is damaged by the Client or any individual present, liability shall fall on the responsible party or jointly on the Client and the service providers.
The Photographer takes all necessary precautions to minimise risk (e.g. use of multiple lenses, backup camera, image backups). However, in the event of a technical issue with photographic equipment or an accident during the session that prevents the delivery of photographs, the service shall be reimbursed in full or in proportion to the loss, without giving rise to compensation of any other kind. In the event of loss or damage to the photographs before delivery, the Client shall only be entitled to a refund of the service.
ARTICLE 10: INTELLECTUAL PROPERTY AND COPYRIGHT
In accordance with the law of 11 March 1957 on copyright and Article L.121-1 of the French Intellectual Property Code, the Photographer retains the rights to all images taken during a session or reportage. Even after the transfer of digital files, the photographs remain the intellectual property of the Photographer and are therefore not royalty-free.
The Client is authorised to print, reproduce, and store the images on any medium for personal, non-commercial use only.
The Client agrees to respect the integrity of the Photographer’s work. No image may be altered in any way.
Any publication of a photograph, regardless of purpose or medium (including online or on social media), must include the credit “Camille Pin” or tag the page @camillepin.photo.
Commercial use of the images by the Client is not permitted unless expressly agreed in writing with the Photographer in advance.
ARTICLE 11: IMAGE RIGHTS AND AUTHORISATION FOR USE
Pursuant to Articles 226-1 to 226-8 of the French Civil Code, every individual has a right to privacy and an inalienable right to their own image.
The Client (or the gift card beneficiary, as applicable) is free to accept or refuse the publication, exhibition, or distribution of their images for promotional or commercial purposes. Prior to each session, the Client has the option to deny authorisation for image usage and must inform the Photographer accordingly.
In the case of a complimentary session or one offered at a reduced rate specifically for promotional purposes, if the Client ultimately refuses authorisation for use, they shall be required to pay the standard, non-discounted rate for the session.
ARTICLE 12: PERSONAL DATA
Information collected via the contact form, booking emails, or telephone exchanges is processed electronically. Such information is intended for use by Camille PIN, Photographer, for client management and booking tracking purposes. The collection of personal data is mandatory for bookings and is legally based on the performance of the service contract, including for the issuance of invoices. Data shall be retained for a period of three (3) years from the date of the service. In accordance with the French Data Protection Act of 6 January 1978 as amended, the Client has the right to access and rectify their personal data. This right may be exercised by contacting Camille PIN via email at pin.camille@hotmail.com. The Client may also object to the processing or request deletion of their data. For more information on their rights, the Client may consult the CNIL website: http://cnil.fr. If the Client believes their data protection rights have not been respected, they may lodge a complaint with the CNIL after contacting the Photographer.
ARTICLE 13: GOVERNING LAW AND DISPUTE RESOLUTION
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, in the event of a dispute, the parties have the option of referring the matter to a consumer mediation service: MEDIATION CONSOMMATION DEVELOPPEMENT. The Client may submit a complaint on their website: http://www.medconsodev.eu or writing to: MEDIATION CONSOMMATION DEVELOPPEMENT / MED CONSO DEV – Centre d’Affaires Stéphanois SAS, Immeuble L’Horizon, Esplanade de France – 4200 SAINT ETIENNE, France. Failing an amicable settlement, any dispute relating to the application of these Terms and Conditions of Sale, as well as to all services to which they apply, shall fall under the exclusive jurisdiction of the French courts, and more specifically the Commercial Court of Aix-en-Provence.
The Client acknowledges having read and accepted these Terms and Conditions without reservation.
